Investors Recover Losses 59% of Time in Arbitration
In 1998, investors filing arbitrations at the National Association of Securities Dealers (NASD) to recover their investment losses won 59% of the time. This is an increase from 54% in 1996 and 57% in 1997.
Likewise, investors pursuing mediation (a negotiated settlement) at the NASD were successful 83% of the time.
Arbitration filings in December of 1998 were up 11% from the year earlier. The NASD assumes that the cause of the increase is the volatility and the market losses from the summer of 1998.
